Part 1: Scope and Applicable Law

§ 1 Scope of Application

These Terms & Conditions (T&C) apply to all contracts concluded between Julia Dencker – The Peaceful Path (hereinafter: "Provider") and her clients via the website or other sales channels (e.g., TikTok Shop, Telegram, Instagram, email, invoice).

These T&C apply to both consumers within the meaning of § 13 BGB (German Civil Code) and entrepreneurs within the meaning of § 14 BGB, unless otherwise specified.

Part 2: Conclusion of Contract, Right of Withdrawal, Payment Terms, Duration

§ 2 Subject of the Contract

The subject of the contract is the provision of trainings, retreats, consulting services, online courses, and digital products. The Provider does not owe any specific results or outcomes.

The Provider’s offerings are not to be understood as medical treatments, therapeutic interventions, or healthcare services. Responsibility for one's own physical, mental, and emotional stability remains solely with the participant.

§ 3 Conclusion of Contract

A contract may be concluded via:

  • the online shop on the website,

  • platforms such as TikTok Shop, Telegram, or Instagram,

  • or through individual agreements via email and invoicing.

By placing an order, the client accepts these T&C. The contract becomes effective upon confirmation or through execution of the service.

§ 4 Right of Withdrawal

This cancellation policy applies exclusively to consumers within the meaning of Section 13 of the German Civil Code (BGB) – that is, natural persons who enter into a legal transaction for purposes that are predominantly outside their commercial or self-employed professional activity.

Entrepreneurs within the meaning of Section 14 BGB – i.e. natural or legal persons or partnerships with legal capacity who, when concluding the contract, act in the exercise of their commercial or independent professional activity – are not entitled to a right of withdrawal.

Right of Withdrawal for Consumers

You have the right to withdraw from this contract within fourteen (14) days without giving any reason.
The withdrawal period is fourteen days from the date of the conclusion of the contract.

by means of a clear declaration (e.g., a letter sent by post or an email) of your decision to withdraw from this contract.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Consequences of Withdrawal

If you withdraw from this contract, we will reimburse all payments received from you – including delivery costs (except for additional costs resulting from your choice of a delivery method other than the standard delivery offered by us) – without undue delay and no later than 30 days from the day on which we received your notice of withdrawal.

We will carry out the refund using the same means of payment that you used for the original transaction, unless expressly agreed otherwise. In no case will you be charged any fees for the refund.

Digital Products & Online Courses

We voluntarily grant you a 14-day right of withdrawal for digital content and online courses as well.

Important:
If you wish to access the digital content or course materials immediately after purchase and explicitly confirm this, your right of withdrawal expires as soon as the contract has been fully performed (§ 356 para. 5 BGB).

You are of course free to wait until the 14-day withdrawal period has expired before accessing the content.

Retreats & In-Person Events

For retreats and events that take place physically and are booked directly through Julia Dencker – The Peaceful Path, a 14-day right of withdrawal also applies from the date of booking – provided you are booking as a consumer.

If you cancel within this period and before the event begins, you will receive a refund minus a non-refundable reservation fee of €100.

If the cancellation period has expired or you cancel on short notice (e.g., due to illness), we will strive to find a fair solution. Please contact us directly.

No Right of Withdrawal for Entrepreneurs

If you are booking as an entrepreneur within the meaning of Section 14 BGB – i.e. as part of your commercial or professional self-employment – no statutory right of withdrawal applies.

EU-wide & international regulations

This refund policy applies to all private customers worldwide. While your local legislation may differ, we voluntarily grant a 14-day right of withdrawal for all digital products and services purchased through this website, when in line with our cancellation policy.

The European Commission provides a platform for online dispute resolution (ODR), available at: https://ec.europa.eu/consumers/odr/.
We
are not obliged and not willing to participate in a dispute settlement procedure before a consumer arbitration board.

§ 5 Prices, Payment Terms, and Due Dates

All prices are stated in euros and include VAT. Accepted payment methods include PayPal, Stripe, Klarna, Google Pay, Apple Pay, Flattr, Amazon Pay, Visa, Mastercard, and American Express.

Payment is due immediately unless otherwise agreed. For purchases via invoice, payment is due within the agreed timeframe.

Part 3: Services and Cancellation Policy

§ 6 Duration and Location of Retreats, Trainings, and Consultations

Duration, times, and locations are specified in the respective service description.

Online services are delivered via the website or third-party platforms such as YouTube or Steady.

§ 7 Scope of Services and Missed Participation

The scope of services is defined in each individual offer.

Missed appointments or content cannot be made up or refunded.

Cancellation Policy for Retreats:

  • Up to 90 days before the retreat: 100% refund minus €100 reservation fee

  • Up to 45 days before: 50% refund minus reservation fee

  • Up to 3 days before: 10% refund minus reservation fee

  • After that: no refund

If a retreat is canceled by the Provider, all refundable payments will be returned within a reasonable timeframe.

No refund will be issued if the event is canceled by the venue or due to force majeure (e.g., natural disasters, pandemics, epidemics, strikes, attacks).

In cases of illness or serious personal circumstances, a goodwill solution (e.g., rebooking or credit) may be arranged individually. However, there is no legal entitlement to this.

Part 4: Client Rights and Responsibilities

§ 8 Access to Online Content

Access to digital content is granted after payment is received. Sharing of login credentials is prohibited.

§ 9 Usage Rights for Digital Content

All content is for personal, non-commercial use only. Redistribution, duplication, or public sharing is prohibited. Copyright remains with the Provider at all times.

§ 10 Data Protection

The Provider collects, stores, and processes personal data only in accordance with legal regulations. For further details, please refer to the Privacy Policy.

§ 11 IT Infrastructure

The client is responsible for ensuring they have appropriate technical infrastructure (devices, internet connection, software).

§ 12 Responsibility for Inner Work

By booking, the client confirms they are mentally, physically, and emotionally able to participate in the offered processes. The Provider assumes no liability for consequences or damages arising from the use of the services.

§ 13 Protection of Know-How and Confidentiality

All materials provided by the Provider are protected intellectual property. Use beyond the contractually agreed scope is prohibited.

Part 5: Confidentiality and Liability

§ 14 Confidentiality

Both parties agree to maintain confidentiality regarding any sensitive information exchanged.

§ 15 Nature of Offerings

The content of the offerings is based on scientific research and practical experience and is created with great care. However, it does not replace medical, psychological, or therapeutic advice or treatment. No healing or success guarantees are made.

§ 16 Limitation of Liability

The Provider is only liable for intent and gross negligence. No liability is assumed for damages resulting from the use or implementation of the content.

§ 17 Force Majeure

In the event of force majeure that makes it significantly difficult or impossible to fulfill the contract, there is no obligation for performance.

Part 6: Final Provisions and Jurisdiction

§ 18 Changes to These T&C

The Provider reserves the right to change these T&C at any time. The current version is always available on the website.

§ 19 Final Provisions

German law applies. The place of jurisdiction, where legally permissible, is Quedlinburg.

If any provision of these T&C is or becomes invalid, the validity of the remaining provisions shall remain unaffected.
